HAZMAT PUBLIC NOTICE
Any facility in Fayette County using or storing HAZARDOUS CHEMICALS or EXTREMELY HAZARDOUS SUBSTANCES, must file a report with the State EPA, Fayette County Local Emergency Planning Committee, and the Fire Department having jurisdiction not later than March 01, 2012. Dear Facility Owner/Operator,
In December 1988, the State of Ohio enacted a law designed to increase the SAFETY of communities in the event of hazardous materials incidents. This new law (Chapter 3750 of the Ohio Revised Code) serves as the state components of the Federal Community Emergency Response Planning and Community Right-to-Know Act known as SARA Title 111.
The Fayette County Local Emergency Planning Committee (FCLEPC) has reason to believe your facility may be subject to this legislation. SARA Title 111 requires companies that uses, process, manufacture or store hazardous materials or extremely hazardous substances to report the presence of such materials to the Fayette County Local Emergency Planning Committee (FCLEPC). Briefly, it applies to facilities that:
- · Use, process, manufactures or stores 10,000 pounds of materials with hazardous characteristics as defined by OSHA Hazardous Communication Standard. (Examples include, but are not limited to gasoline, diesel fuel, kerosene, fuel oil, propane, new and used motor oil, anti-freeze, transmission and brake fluids, paint, compressed gasses, 1,1,1, trichloroethane, methyl ethyl ketone, etc..)
- · Use, process, manufactures or stores the listed threshold planning quantity of Extremely Hazardous Substances. The Quantity ranges from one (1) to five hundred (500) pounds, depending on the substance. (Examples include, but are not limited to Chlorine, Ammonia, Formaldehyde, Sulfuric Acid, Nitric Acid, etc..)
If you think these requirements may be applicable to your facility, fill out the report form found in the Facility Reporting Compliance Manual and mail to the proper areas. Failure to comply with the Right-to-Know program can result in fines of up to $25,000 per day.
